General terms and conditions
Mediate Travel sleeperoo Ireland provides sustainable overnight stays in unusual locations. The overnight stay includes a ChillBox full of delicious snacks and drinks for your comfort and enjoyment.
The following general terms and conditions regulate the contractual relationship between Mediate Travel sleeperoo Ireland and the guests who book services via the booking engine.
These general terms and conditions apply exclusively to the contract. Other terms and conditions are not part of the contract. These general terms and conditions only apply.
The contract language is English.
The internet offers represent a non-binding invitation to guests to buy goods or services. They do not constitute an offer to conclude a contract. After entering the data and clicking on the order button at the end of the booking process, the guest makes a binding offer to conclude an occupancy contract.
The reservation request must contain the following information: first name, last name, address, dates of arrival and departure, number of people, date of birth, e-mail address, and telephone number.
The booking is accepted at the end of the booking process upon receipt of the booking confirmation.
Entries can be corrected at any time with the delete key before placing the order. As you proceed through the order process you will be informed of further correction options. The order process can be ended at any time by closing the browser window.
Storing the order data
The order is saved along with details of the concluded contract. The terms and conditions can be accessed at any time via the website.
In order to execute the contract fully customer data must be passed on to the spot and the host on-site. Mediate Travel sleeperoo Ireland observes the principle of data-economy, that is, the scope of the data given is limited to the minimum possible that will allow for the successful execution of the contract.
Cancellation of the contract by sleeperoo Ireland Ltd
Mediate Travel sleeperoo Ireland is entitled to withdraw from the contract in the following cases:
- In the event of operational disruptions, especially those caused by external factors, not under the influence of the company.
- In the event of an external occurrence that cannot be avoided even with the utmost care that can reasonably be expected. (Force Majeure i.e. war, the threat of war, internal unrest, unstable political conditions, reactor accidents, epidemics, pandemics, natural disasters)
- When the guest is booked under false information that is important for the contractual relationship.
In these cases the guests have no right to make a claim against Mediate Travel sleeperoo Ireland
The guest is only entitled to cancel free of charge if, for reasons for which Mediate Travel sleeperoo Ireland is responsible, they can no longer be expected to adhere to the contract, Mediate Travel sleeperoo Ireland has previously consented in writing to the withdrawal or right of withdrawal from the contract between the guest and Mediate Travel sleeperoo Ireland. Such a right of withdrawal ceases to exist if it is not exercised in writing within the period granted by Mediate Travel sleeperoo Ireland.
Guests must cancel their bookings in writing. this also applies to reductions in guest numbers.
If the guest cancels a booking while not authorized to do so, Mediate Travel sleeperoo Ireland can demand compensation for the travel arrangements and expenses incurred. The same applies if the guest does not make use of the agreed and arranged services without having previously canceled.
The compensation amount is a lump sum which takes account of the usually saved expenses and the possible other earnings of the Sleeperoo. The deciding factor is the time of the receipt of the cancellation declaration at Mediate Travel sleeperoo Ireland. The flat-rate amount of the lump sum compensation from the travel price before departure is staggered as follows:
Up to 31 days = 20%
Up to 15 days = 40%
Up to 07 days = 60%
Up to 01 days = 80%
Later and no-shows = 100 %.
The calculation of the flat rate takes account of the usually saved expenses, the possible other earnings and the cost of the delivery services of the Sleeperoo. The guest is free to prove that the actual damages are less than the requested compensation. Should the costs incurred by Mediate Travel sleeperoo Ireland be demonstrable higher than this lump sum then the guest will owe the higher amount.
The prices valid at the time of receipt of the reservation request apply.
Payment is due immediately upon completion of the booking process.
Bank transfer, PayPal and credit cards are all acceptable methods of payment,
The gift voucher has a nominal value in Euros, which entitles the holder to use it as means of payment.
Vouchers can be bought and redeemed at www.sleeperooireland.ie using the dedicated online order form (shopping cart system).
The voucher, with the specification of its Euro value, the corresponding invoice and voucher code will be generated immediately after the order is placed and sent to the buyer by e-mail. Alternatively, the voucher can be sent by post with a decorative envelope.
Vouchers are valid for a period of 5 years, from when the voucher is purchased. The voucher can be redeemed at any time during this period of validity.
Having entered the voucher code on the Mediate Travel sleeperoo Ireland Webseite the redeemer can make a selection from the available experiences and locations, view and accept the terms and conditions, and the house rules. The voucher code must be entered when paying for the booking. Subsequent crediting of a voucher is not possible.
Partial redemption of a voucher is allowed.
The voucher can only be redeemed for the goods and services offered by Mediate Travel sleeperoo Ireland. Vouchers cannot be exchanged for cash from Mediate Travel sleeperoo Ireland. Vouchers cannot be used to buy other vouchers from Mediate Travel sleeperoo Ireland.
Only one voucher can be redeemed per booking. A combination of several vouchers is not possible.
Guests who cause damage to buildings and inventory or lose items like keys which are within the framework of the statutory provisions for replacement will be held duly liable.
The guest is obliged to report any defects immediately. The guest is also obliged to make a reasonable attempt to remedy the fault and by so doing minimize or prevent further impending damage. If there is a possibility that Mediate Travel sleeperoo Ireland will suffer exceptionally high damage the guest must bring this to the attention of the company immediately.
Mediate Travel sleeperoo Ireland only accepts liability for damage resulting from injury to life, limb or health which is based on an intentional or negligent breach of duty by Mediate Travel sleeperoo Ireland or on an intentional or negligent breach of duty by a legal representative or vicarious agent of Mediate Travel sleeperoo Ireland.
Mediate Travel sleeperoo Ireland only accepts liability for other damages that are based on an intentionally or grossly negligent breach of duty by Mediate Travel sleeperoo Ireland, or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of Mediate Travel sleeperoo Ireland.
Mediate Travel sleeperoo Ireland is only liable if a duty is violated, which makes the proper execution of the contract possible and upon which the guest can trust and be trusted (an essential contractual obligation).
If an essential contractual obligation is violated through slight negligence Mediate Travel sleeperoo Ireland is liable in the amount of contractually typical and reasonably foreseeable damages.
Except in cases of intent, liability for loss of profit, purely financial loss, indirect and consequential loss is excluded.
Liability for theft or damage of valuables can only be accepted if these have been expressly given to the host on-site for safekeeping. Unless Mediate Travel sleeperoo Ireland or its vicarious agents caused the loss or damage intentionally through gross negligence, the statutory provisions apply.
There is no liability for damage to vehicles and bicycles, including contents, that are on the host’s property unless the loss or damage was caused intentionally or through the gross negligence of Mediate Travel sleeperoo Ireland or its vicarious agents.
No liability is assumed for the cloak room.
Items left behind by the guest will only be forwarded at the request, risk and expense of the guest.
Statute of limitations
The period of limitations for claims against Mediate Travel sleeperoo Ireland is two years. Claims for damages against Mediate Travel sleeperoo Ireland become statute-barred five years after the claim arises, regardless of knowledge. The limitation periods do not apply to claims based on an intentional or grossly negligent breach of duty by Mediate Travel sleeperoo Ireland or an injury to life, limb or health of the guest.
The house rules are part of the contractual agreements and are therefore an integral part of the occupancy contract. The house rules can be viewed on the internet at any time and are also available on site.
Changes and additions to the contract or the general terms and conditions – including this provision – only take effect if they are made in writing. Unilateral changes made by the guest have no effect.
The place of fulfillment and payment is Dublin, Ireland.
If one or more of the provisions of these general terms and conditions are or become invalid or void this does not affect the validity or effectiveness of the remaining conditions. In this case, the parties already agree that the invalid provision will be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision. The same applies to any gaps in the agreement.
The jurisdiction and laws governing these general terms and conditions are the jurisdiction and laws of the Republic of Ireland.
